Nothing in the Buyer's Terms of purchase shall override, cancel or modify any of the Company's Standard Conditions of Trade.
If any part of these conditions are considered invalid, illegal ot unenforceable, the validity or any other part of these conditions will not be affected. The contract shall be governed and interpreted in accordance with English Law.

Charges & Payment Terms

Charges for goods and services supplied by the Company shall be paid in full on or before delivery or completion, unless otherwise agreed by the company, in writing. The price payable for goods ordered is set out on our website at the time of ordering. Upon agreement of contract between the buyer and the company these prices are non negotiable.
All prices stated are excluding VAT, chargeable at the current rate.

Title / Ownership

The property in and title to goods supplied by the company shall remain within the company until:
a) The buyer shall have paid the price plus VAT in full and
b) No other sums whatever shall be due from the buyer to the seller
In the event of non-payment of sums due to the company from the buyer, the company shall be entitled to enter the buyer's Premises and to physically re-posses and remove there from similar goods supplied by the company for which payment has not been received. It will be assumed that where the buyer purchases similar goods from the company on a regular basis that a stock rotation system had operated and goods still held relate to invoices still outstanding for which full payment plus VAT hasn't been made.

The buyer has the responsibility to examine goods supplied by the company and to identify defects in materials and/or workmanship which might cause damage or injury. Illustrations, descriptions, weights and measurements shall be taken by the buyer as a guide only, and are not binding in detail. Any defects should be reported to the company in writing within seven days of the delivery date. No claims for damages / discrepancies can be made after installation as installation of our materials constitutes acceptance of the product in its current state.
While the company endeavours to hold sufficient stock to meet all orders, if insufficient stock is held or the stock item has been discontinued, the company may, at its discretion, supply or deliver a substituted product or refund the buyer for such goods as soon as possible. The company reserves the right without notice and without affecting the validity of the contract to make such changes in materials, dimensions and design as are reasonable and desirable.

The company will advise the buyer whenever possible of approximate delivery times. All times and dates for dispatches and deliveries quoted are estimates and not binding on the company. The company will have no liability for failure or delay to supply or deliver, or for any defect or damage to goods supplied that is caused by force majeure or any event or circumstances beyond our reasonable control. Claims by the buyer for shortages or non-delivery must be made to the company in writing within seven days of the delivery date. It is the responsibility of the buyer to check goods on delivery.
Due to insurance guidelines, deliveries are made to the ‘kerb side’ and not inside the house. The buyer must therefore be available to take delivery of items from the entrance of the building. Deliveries may be made by lorry, so it is assumed the delivery address will be accessible. The buyer must inform the company of any delivery restrictions at time of order. Requests for estimated delivery times will be at the discretion of the delivery company. If an order arrives as arranged but delivery cannot take place because the buyer is not at home, or there is inadequate help available, the buyer will be liable for any additional costs incurred for redelivery.
Wood Floor Designs use reliable delivery partners to ensure delivery service levels are maintained. The buyer must therefore check the packaging for any visual damage to the goods and sign for the order on arrival. If any goods are damaged or missing, please make sure it is noted on the courier’s paperwork. The company also strongly suggests that the buyer makes contact directly as soon as possible to ensure the company is aware of the problem. This notification should be made to the company in writing within three days of receipt of the goods. Photographic evidence is useful when making claims.
The company will not be held responsible for any consequential losses, and advises not arranging installation until all goods have been received and checked. Where goods are refused on delivery that are found to be undamaged on return, the company reserves the right to pass on any carriage charges incurred in returning the goods and re-issuing.
If goods are damaged the buyer must sign for them as damaged.
If the buyer signs the delivery as checked or unchecked and goods turn out damaged, the company cannot replace or reimburse the buyer.
If the packaging is intact, the buyer must not assume that the goods are undamaged.

The buyer shall be responsible for assembly of the goods in accordance with the company's instructions and shall ensure that such instructions have been obtained from the company. Failure to assemble goods in the manner advised by the company’s instructions will invalidate the company's responsibility for damage caused to or by the goods.
The company recommends oiled floors are treated in accordance with the manufacturers advice after fitting to ensure that they are fully protected.

Furthermore, guarantees will only apply where goods have been installed correctly, then treated and maintained in a suitable environment, in accordance with the manufacturers instructions.
It is advisable that fitting is not booked until delivery of the goods has taken place, to ensure the wood is left to acclimatise. Damage caused to and by goods which are fitted without consideration for acclimatisation cannot be compensated for by the company.
